1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the FitVault AI mobile application ("App") and all related services. By accessing or using the App, you agree to be bound by these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
FitVault AI is an AI-powered fitness and nutrition tracking application that provides:
- AI-powered food recognition and barcode scanning for nutrition tracking
- Custom workout routine creation and tracking
- An AI fitness coaching chat assistant
- Step and activity tracking via device health integrations
- Nutrition diary and macro tracking
- Progress analytics and charts
The App is available on iOS and Android devices. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.
3. Eligibility
You must be at least 13 years old (or 16 years old in the European Economic Area) to use FitVault AI. By using the App, you confirm that you meet this age requirement. If you are under 18, you confirm that you have your parent or guardian's permission to use the App.
4. User Account
FitVault AI does not require account registration. Your subscription is tied to your Apple ID (iOS) or Google Play account (Android). You are responsible for maintaining the security of your device and app store account. You agree not to share your device or subscription access with others in violation of these Terms.
5. Subscriptions and Billing
5.1 Free Trial
FitVault AI offers a 7-day free trial upon first download. During the trial, you have access to all Pro features. The trial automatically converts to a paid subscription at the end of the trial period unless you cancel before the trial expires.
5.2 Subscription Plans
After the free trial, the following paid plans are available:
- Pro Annual: Billed once per year. Provides the best value.
- Pro Monthly: Billed once per month.
Prices are displayed in the App and on our website in your local currency. Prices may vary by region and are subject to change.
5.3 Automatic Renewal
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the renewal date. Your payment method on file with Apple or Google will be charged automatically.
5.4 Cancellation
You can cancel your subscription at any time through:
- iOS: Settings → [Your Name] → Subscriptions → FitVault AI → Cancel
- Android: Google Play Store → Subscriptions → FitVault AI → Cancel
Cancellation takes effect at the end of the current billing period. You retain access to Pro features until that date.
5.5 Refunds
All purchases are processed through Apple App Store or Google Play Store. Refund requests are subject to their respective refund policies:
- Apple: Request a refund at reportaproblem.apple.com
- Google: Contact Google Play support within 48 hours of purchase for refund eligibility
We do not process refunds directly. If you cancel your subscription before the free trial ends, you will not be charged.
5.6 Promotional Codes
We may offer promotional codes that grant complimentary access to Pro features for a specified period. Promo codes are:
- Single-use only and non-transferable
- Valid only for the period specified when issued
- Not redeemable for cash or exchangeable
- Subject to expiration dates
6. Acceptable Use
You agree to use FitVault AI only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Use the App in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to our servers or networks
- Use automated tools to scrape or extract data from the App
- Share subscription access commercially or resell subscription access
- Use the AI coach to generate illegal, harmful, or offensive content
- Attempt to circumvent subscription requirements through technical means
7. Health Disclaimer
Always consult a qualified healthcare professional before starting any diet, exercise program, or making significant changes to your nutrition. Do not rely on FitVault AI for medical decisions. If you have a pre-existing medical condition, are pregnant, or have specific dietary requirements, seek medical advice before using the App.
Calorie and nutritional data is estimated and may not be 100% accurate. AI food recognition is not perfect and should not be used for strict medical dietary management.
8. Intellectual Property
FitVault AI and all its content, features, and functionality (including but not limited to text, graphics, logos, icons, images, and software) are owned by us and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
9. User-Generated Content
Any content you enter into the App (diary entries, workout data, profile information) remains yours. We do not claim ownership over your personal fitness data. This data is stored locally on your device as described in our Privacy Policy.
By using the AI chat feature, you grant us a limited license to process your messages for the purpose of generating AI responses. We do not store or use your chat messages for any other purpose.
10. Privacy
Our collection and use of personal information in connection with the App is described in our Privacy Policy, which is incorporated into these Terms by reference.
11. Third-Party Services
The App integrates with third-party services including Apple Health, Google Health Connect, and RevenueCat. Your use of these integrations is subject to the respective third parties' terms and privacy policies. We are not responsible for the practices of these third-party services.
12. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses. We do not guarantee the accuracy of nutritional information, AI responses, or fitness recommendations provided by the App.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE SUBSCRIPTION IN THE 12 MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify and hold harmless FitVault AI and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, violation of these Terms, or violation of any rights of another person or entity.
15. Termination
We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination will survive termination, including intellectual property provisions, disclaimers, and limitations of liability.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by updating the "Last updated" date at the top of this page. Your continued use of the App after changes constitutes acceptance of the new Terms. If you do not agree with changes, stop using the App and cancel your subscription.
17. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.
